Planner's Conditions Which Must be Met Before Aviator Heights is
Finalized

1.
All applicable provisions of the Eatonville Municipal Code,
whether or not set out specifically herein, shall be applicable to
the proposed development unless specifically waived below.
2.
A transportation study was submitted with the development
application and the following mitigation is required as a condition
of final approval:
Weyerhaeuser Road
Design:
The applicant shall be responsible for preparing
Weyerhaeuser Road
reconstruction plans from the public/private road boundary at
adjacent to lot 21 to
Center Street E.
This design should include
sidewalks, stormwater facilities, and street improvements.
The design should include a realignment of
Weyerhaeuser Road North
with
Weyerhaeuser Road South
. The design shall be
approved by the Town’s Public Works department prior to final
approval. Out of that
design, the applicant shall construct the western sidewalk and
identified stormwater improvements, but shall not be responsible for
street reconstruction or the eastern sidewalk improvements.
The town may require minor street improvements in order to
complete the stormwater and sidewalk improvements, to ensure that those
improvements are compatible with the existing street, and to ensure
safety until which time as full reconstruction will occur.
Sidewalks on the west side of
Weyerhaeuser Road
between
Center Street
and the entrance to the development shall be 8 feet in width to
facilitate their use as part of a future trail system.
3.
The proposed private road within the development is sufficient
for continued processing, however, it should be noted on the face of
the plat that this is a private road, taxiway, and utility easement.
Roadway design and construction shall be in accordance with all
applicable provisions of the EMC. All
roadway plans shall be signed and stamped by an engineer and the plans
shall be submitted to the town public works department for review and
approval prior to construction. The
proposed security gate and turnaround is unacceptable to the town as it
may interfere with the taxiing of aircraft on the designated aircraft
access easement located on lot 1 and would make emergency vehicle access
and town access to public utilities located within the development more
difficult. A maintenance
agreement shall be created and recorded for the private road as a
condition of final approval. The
agreement shall be approved by the planning director and public works
director prior to being brought to council at final approval.
The private road design including stormwater management and
sidewalks should be airplane compatible and shall be evaluated by the
town public works director or his/her designee for compatibility.
Five foot sidewalks are required on both sides of the proposed
private road and around the cul-de-sac.
4.
Sanitary Sewer- The preliminary design for Sanitary Sewer is
sufficient to continue processing this application, however the town
requires that the northernmost manhole proposed be relocated to the
northern property line within the dedicated utility easement and not in
the cul-de-sac. Further,
the sanitary sewer line shall be extended to the NE corner of lot 13.
Sanitary sewer design and construction shall be in accordance
with all applicable provisions of the EMC.
Final plans shall be signed and stamped by an engineer and the
plans shall be submitted to the town public works department for review
and approval prior to construction.
5.
The utility easement running to the northeast corner of lot 13
from the cul-de-sac shall be additionally dedicated for ingress and
egress to the registered owner of tax parcel 0416144142.
6.
Storm Sewer- The preliminary design for stormwater management is
sufficient to continue processing this application.
Final plans shall be engineered in accordance with the 2005
Pierce County Stormwater Management and Site Development Manual and be
approved by the public works department prior to construction.
These plans shall include identification of necessary bio-swale
landscaping including plant variety and placement.
Installation of an engineered stormwater management system shall
be a condition of Final Plat Approval.
7.
Water Mains/Fire Flow- The preliminary design for Water and Fire
Flow is sufficient to continue processing this application.
The applicant shall pay all costs associated with fire flow
studies as required for the continued processing of this application.
Water system design and construction shall be in accordance with
all applicable provisions of the EMC.
Final plans shall be signed and stamped by an engineer and the
plans shall be submitted to the town public works department for review
and approval prior to construction.
8.
Engineered electrical plans must be submitted to the Town of
Eatonville Public Works Department
for approval prior to final plat approval. Electrical
system design and construction shall be in accordance with all
applicable provisions of the EMC.
9.
The applicant shall construct a 6-foot wooden fence along the
east side of lots 13-23 and tract D as a means to prevent access to
this private section of
Weyerhaeuser Road North
and to ensure safety.
10.
Sidewalks within the development and along the private road and
along the north side of the public road shall be 5 feet in width.
Sidewalks along the south side of the public right of way which accesses
the private road shall be 8 feet in width to accommodate future trail
system connections. Crosswalks
shall be constructed and painted at all intersections.
11.
Light and glare mitigation.
The applicant is required to mitigate expected light and glare
from vehicles exiting the site by planting site obscuring trees and
landscaping to reduce that light which may adversely impact the
residents of tax parcel 0416144105 and 0416144091 or, at the request of
the property owners of the above mentioned tax parcels, the applicant
may be alternatively required to pay those property owners an equivalent
amount to the cost of materials.
12.
Open Space. The EMC
chapter 17.20 requires an open space dedication.
Tract D is proposed as open space and measures 11,426 square
feet. The applicant shall
develop tract d as a pocket park including the installation of a multi
use court and a plaything. Site
design, landscaping plans, and a maintenance agreement shall be approved
by the town public works department prior to installation.
13.
Tracts B and C shall be consolidated into one tract.
Any hangers or other facilities constructed on the site
which are to have individual tax parcel numbers would be subject to
binding site plan requirements and would require a separate application.
14.
All plat fees and engineering plan review fees shall be paid
prior to final approval.
15.
The following shall be recorded on the face of the plat:
"This property
is located within the Airport Overlay Zoning District in which a
variety of airport aviation activities occur. Such airport aviation
activities may impact the use of your property."
16.
Ganged
Mail Box. The applicant
shall identify and designate a location for a ganged mailbox structure.
The structure shall be installed prior to final approval of
the plat.
17.
Taxi
Way
Paving and Construction. The
applicant shall pave the gravel taxiway on the east side of the runway
for the entire frontage of the applicant’s property and shall connect
the taxi way to the runway at two points.
Further, the applicant shall construct a private access road from
the public road to the proposed hanger locations on tract C, construct a
separate taxiway from the private road to the proposed hangers,
maneuvering areas, and runway access, and construct aircraft taxing and
maneuvering areas, fire access, and vehicle access in front of all
proposed hanger sites. All construction shall be in accordance with Town
of Eatonville public works standards, shall be airplane compatible, and
shall be approved by the public works director or his/her designee prior
to construction.
18.
It shall be recorded on the
face of the plat and in a restrictive covenant that (in accordance with
FAR Part 77 (Exhibit T)) “Any proposed construction within
the aviator heights plat which penetrates FAR part 77 surfaces shall
submit form 7460-1 to the FAA and receive comment from the FAA prior to
making application for a building permit or beginning construction.
The building official, town planner, or public works director for
the town of
Eatonville
may condition the construction or building permit by imposing FAA
proposed safety requirements such as installation of warning lights,
flashing beacons, painting buildings in red and white patterns, and
other safety features specified by FAA. ”
19.
The statement “Future uses as permitted in Ordinance 2006-6”
on the face of the plat shall be replaced with “future
uses as permitted by the EMC.”
20.
The ROW dedication which is to facilitate a future road
connection through the applicant’s property and which separates
tracts A and B as shown on Exhibit DD shall be realigned so as to
eliminate any potential need for a slope easement from the adjacent
property to the south.
21.
Private Road/Taxiway signage which alerts drivers and pedestrians to the
hazards of the taxiway shall be installed at the entrance to the
private road; however, such signage shall not prohibit any public access
with statement such as “no trespassing.”
