(The Washington State Legislature has adopted new SEPA rules that have not been incorporated in the town's code on SEPA. The town's code needs to be extensively revised in order to incorporate new SEPA rules, such that all of the provisions in the existing chapter should be completely repealed...) (Passed four to one at First Reading with Councilmember Brenden Pierce voting "No.")

    B. Ordinance 2010-5 (Second reading) amending the point system for reimbursement to volunteer fire fighters by adding one point for three hours standby in the fire stateion, amending Section 2.28.120 of the Eatonville Municipal Code 2.28.120.
  
(The town's fire chief is utilizing volunteer firefighters in addition to career firefighters/paramedics, evenings and weekends to achieve a staffing level of two firefighters 24 hours a day, seven days a week...the town has established a point system to compensate volunteer firefighters and the fire chief recommends that one point be allowed for "station standby..." The money to fund payment for this activity was included in the 2010 budget.) (Passed unanimously.)

   C. Resolution 2010-M authorizing the mayor to sign a contract agreement with Multicare Health System WIC (Women, Infants and Children's nutritional program) services for an office lease. (Tabled from March 8 meeting.) (March 22 vote - Passed unanimously.)

     New Business:

    A. Ordinance 2010-4 (First reading) accepting the donation of certain real estate from Harold Walter Burlingame to be used for airport related purposes. (The property is 6.06 acres according to the Pierce County Assessor's web site Pierce County Assessor-Treasurer ePIP - the assessor's site also lists the Town of Eatonville as "Taxpayer name.") (Removed from agenda for lack of signature.)

    B. Resolution 2010-O setting the rates for refuse collection and recycling collection in the town and repealing Resolutions 2007-N and 2008-R. (Small rate changes - Example: - Commercial - 1 Yard 1X WK - Current Rate - 77.44 - New Rate - $79.37: Residential 65 Gal EOW - Current Rate - 17.10 - New Rate - $17.38.) (Passed three to two with Councilmembers Bob Schaub and Jim Valentine voting "No.")

   A. Ordinance 2010-1 (continuation of second reading) amending the Eatonville Municipal Code (EMC) Section 10.18.040 further restricting bus parking in residential areas. (The town council has received complaints from citizens residing in residential areas of town regarding parking and storage of buses in these residential areas...the council wishes to require bus owners to story their vehicles in other areas of the town or on property designated for such use...A) Buses shall not be parked on town streets in or abutting residential zones. B) In all other zones, buses shall not be parked on town streets or rights-of-way for more than 24 consecutive hours.)  (Tabled until April 23 council meeting.)

   New Business:

   A. (The town needs to sign a sheltering agreement  and agrees to pay euthanasia charges if the humane society can't find the animal a new home. The agreement will be in effect from February 9, 2010 to December 31, 2010.)  (Removed from agenda so attorney can work on details.)

     C. Resolution 2010-H to confirm mayor's appointment of new planning commission Phil Beach. (Beach served on the planning commission for six years and is willing to serve again.) (Passed three to two with Councilmembers Allison and Pierce voting "No.")

     D. Approval for the extension of Aviator Heights Plat. (from Nybo Construction, Inc. "While most improvements have been completed, our progress for final completion of the plat has slowed due to the downturn of the economy and the credit crisis. A one year extension should enable us to complete the plat. Jerry Nybo.")

(Councilmember Pierce asked for an amendment requiring a developers agreement be signed before the extension if granted. Passed.)

    B. Ordinance 2010-2 accepting the donation of $50,000 from Peter and Christine Kock and authorizing the mayor to sign an agreement limiting the use of funds for a truss bridge spanning the Little Mashell River at Weyerhaeuser Road South. (Peter and Christine Kock approached the town seeking to make an end of year gift to the town. They have asked the funds be used to purchase and install a pedestrian bridge across the Little Mashell River. The council hereby accepts a donation of Fifty Thousand Dollars ($50,000) from the Kochs.) (Passed unanimously.)

   C. Resolution 2010-E adopting an amendment, related to the state purchasing card program, to the Personnel Policy Manual. (An amendment to the manual is needed to establish policies and procedures for the use of state issued purchasing cards. The inclusion of this minor policy adjustment in the manual is chiefly necessary for the efficient operation of the town.)

   D. Resolution 2010-F authorizing the mayor to execute a Memorandum of Understanding between the Eatonville Police Department and Otumhealth Pierce Regional Support Network (RSN). (The citizens of the town would benefit from the mental health services provided by RSN and RSN would benefit from the Eatonville Police Department's professional policing services.(Passed unanimously.)

   E. Appoint Committee Members. (Committees need to be appointed in January according to the Eatonville Municipal Code 2.04.009 D.)

     (Claim Number 27835 was held over from the December 14, 2009 council meeting, the last meeting of the Smallwood administration. Councilmember Jim Valentine asked that the claim be held from DC and Associates for shoddy and incomplete work on Nevitt Park. The council voted to withhold the funds until they are satisfied with the work. There have been numerous complaints about this subject from elected citizens and non-elected citizens. Town Planner Nick Bond states, in a memo dated January 7, 2010, that the work has now been completed and says the town will withhold a five percent “retainage to make sure all subcontractors have been paid. When we get a release from the Department of Revenue we will release the retainage but only after they provide a one year maintenance bond.”)

    New Business:

      A. Resolution 2010-A to authorized the mayor to sign an attorney fee agreement for civil work with Morris & Taraday.     
      ("The current Attorney Fee Agreement for Civil Work is with the firm Smith, Alling Lane and Edward G. Hudson...the Town of
Eatonville no longer desires to contract with Smith, Alling Lane and Edward G. Hudson for services...the Town of Eatonville wishes to contract with Morris & Taraday, P.C. for attorney services for civil work...Be it resolved by the Council ...that the appointment by the mayor of Carol Morris & Jeff Taraday...is hereby resolved." 
      Morris & Taraday are a firm out of Seattle, 1319 Dexter Avenue North, 98109. specializing in land use issues. A profile of Jeff Taraday on the Internet notes "Practice areas as Real Estate (40%), Land Use/ Zoning (30%Government/Cities/Municipalites (30%)
     The town would agree to pay "a minimum monthly retainer of $2,000 per month. Among the items listed in a four page agreement is "C. Reimbursable Costs. The Town Attorney shall be reimbursed for costs and advances for such items as legal messenger services, court filing fees and other similar expenses.
     "Section 3. Equipment and other Resources. The Town Attorney shall provide its own cell phone, unlimited access to on-line computer legal research services, long distance telephones, cell phone service, mileage, etc."
    The agreement also states, in part, "In consideration of the minimum retainer, the Town Attorney will travel to town hall
free of charge once per month." (Emphasis added.)
(Passed unanimously.)

    B. Resolution 2010-B to authorize the execution of a professional services contract with Pierce County Auditor's office.  
   (This resolution
refers to eliminating Animal Control in within Eatonville's town limits and paying Pierce County Animal Control to take over animal control functions and duties within the town. In part the resolution reads, "...the Town s in need of services related to the care and control of animals for...Eatonville...the County has the capability to provide animal control and pet licensing to other jurisdictions with [sic] the boundaries of Pierce County and the Town is in need of animal control and pet licensing and wishes to contract for these services with the County..." (Tabled until January 25 meeting.)

   Among six "Town Responsibilities" in a five-page agreement are:
 
   1. Adopt current Pierce County Code chapters V and V1 relating to animal enforcement and licensing
prior to the acceptance of this contract. (Emphasis added.)

   3. The Town or its citizens should request non-emergency services by calling County Animal Services PETS line at 253.798. PETS. Emergency calls should be made through the 911 System, by calling 911 and requesting dispatch through LESA.
  
   4. Provide and maintain current immediate emergency contact information for the Town of Eatonville. Contact information at time of execution this contract is:

   5. Within an hour of County staff leaving a message for the emergency contact in item #4 above, respond to County requests for authorization of animal cruelty confiscation by either authorizing or refusing authorization through verbal communication with written follow-up within 24 hours. Post confiscation costs incurred by the County for authorized animal cruelty confiscation shall be borne by the Town.

   6. Be responsible for all criminal and civil litigation and all judicial action related to animal cases that fall with their jurisdiction.

   C. Resolution 2010-C authorizing the mayor to sign a contract renewal agreement with Pierce County Department of Emergency Services. (The purpose of the agreement is to "provide an economical mechanism to provide for the common defense and protect public peace, health and safety and to preserve the lives and property of the people...against the existing and increasing possibility of the occurrence of major emergencies or disasters, either man-made or from natural causes."
  The duration of the agreement is from January 2010 to December 2014. This is a standard agreement which the town has used for years.
 (Passed unanimously.)

   D. Ordinance 2010-1 amending Eatonville Municipal Code (EMC) Section 10.18.040 further restricting bus parking in residential zones. (A. Buses shall not be parked on town streets in or abutting residential zones. B. In all other zones buses shall not be parked on town streets or right-of-way for more than 24 consecutive hours. (Tabled until February 8.)

  Added to agenda - Resolution 2010-D accepting the donation from Peter and Christine Koch and authorizing the mayor to execute a donation agreement between the town and the two donors. (Passed unanimously.)
