Van Eaton Park Timeline
This Timeline Was Put Together Months Ago by a Concerned Citizen...

December 2004 - Mayor Rath had dozer/operator on the upper Park land property clearing it off and leveling the grounds. Dozer and operator were said to be Jerry Nybo’s. Mayor said he was doing the clearing to improve the park.

February 28, 2005 - Council Meeting - Town Council Study Session on selling the Park.

February 28, 2005 - Council Meeting - Resolution 2005-O introduced to declare parkland surplus property and to authorize the advertising to sell said land.

March 1 or 2 - A day or two after the Feb.8 Council meeting I was in the Town Hall lobby to request the meeting minutes. Mr. Walker, an appraiser for the parkland, came in and introduced himself to Mayor Rath in the lobby. When they were walking back to the Mayor’s office I overheard the Mayor say, “I wasn’t going to get it appraised but ‘they’ wanted me to.”

March 28, 2005 - Council Meeting - Resolution 2005-O passed. Planner gave overview of procedures to council to be followed if sale of land is approved.

April 11, 2005 - Council Meeting- A motion by Ray Harper and second by  Waylon Jumper to set the selling price of the Orchard Ave. properties at $355,000 and to authorize the Mayor to act as an agent. Motion passed (no resolution was made for this action).

April 12, 2005 - Mayor Rath signs real estate papers with ERA Realty to list Park property for $355,000.

May 5, 2005 - Mayor Rath signs real estate contract for the Town for sale of Park property to Jerry Nybo of DN Properties LLC. for $320,000.

June 27, 2005 - Council Meeting - Resolution 2005-QQ authorizing Mayor to purchase property on Mashell Ave. (Terry Van Eaton Car Lot) passed.

July 11, 2005 - Council Meeting - Mayor stated that Town has an offer for the sale of the Van Eaton Parkland.
Motion by Councilmember Harper to remove Orchard and Larson Ave. as designated park land from the Comp. Plan. Seconded by Councilmember Mike Gallagher.  Motion Carried.

July 22, 2005 - Judge Armijo denied Steve Van Cleve’s suit to stop Park sale.

Sept. 26, 2005 - Council Meeting - Mayor announces that the Park land has just been sold and money accepted.
